By accessing or using any services provided by Kazepute LLC ("Kazepute," "we," "us," or "our"), including the website at kazepute.com and all related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.
You must be at least 18 years of age to use our services. If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
You must provide accurate, complete, and current information when creating your Account. You are responsible for maintaining the confidentiality of your Account credentials, including your password and any SSH keys associated with your Account. You are responsible for all activity that occurs under your Account.
You must notify us immediately at support@kazepute.com if you become aware of any unauthorized access to or use of your Account. Kazepute will not be liable for any loss or damage arising from your failure to protect your Account credentials.
Kazepute provides unmanaged virtual private server (VPS) hosting. We provision and maintain the underlying infrastructure, including compute resources, storage, and network connectivity. You are solely responsible for managing your Breeze, including but not limited to:
Kazepute does not provide managed support for software running on your Breeze. Our support team can assist with infrastructure-level issues such as network connectivity, hardware failures, and platform-related questions.
Marketplace Apps are pre-configured application stacks that are deployed at the time of Breeze creation. These applications are provided as a convenience and are delivered on an "as-is" basis. Third-party software included in Marketplace Apps is governed by their respective licenses.
Kazepute is not responsible for application-level bugs, security vulnerabilities, or compatibility issues in Marketplace Apps after deployment. You are responsible for maintaining, updating, and securing any software running on your Breeze, including Marketplace Apps.
Kazepute allows you to upload custom ISO images for installation on your Breeze. By uploading a custom ISO, you represent and warrant that:
Kazepute reserves the right to remove any custom ISO that violates these Terms or poses a security risk to our infrastructure.
Services are billed on a monthly subscription basis. Payment is processed through Stripe, Inc. Charges begin when your Breeze is provisioned and recur automatically each billing cycle until cancelled.
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service or interfere with any other party's use of the Service. The following activities are strictly prohibited:
Kazepute reserves the right to determine, in its sole discretion, whether any activity constitutes a violation of this Acceptable Use Policy. Violations may result in immediate suspension or termination of your Account without notice.
You retain full ownership of your Content. Kazepute does not claim any intellectual property rights over the data you store on your Breeze.
Kazepute does NOT provide automatic backups. You are solely responsible for implementing and maintaining your own backup strategy. We strongly recommend regular off-site backups of all critical data.
When a Breeze is destroyed — whether by you, by Kazepute due to a Terms violation, or due to account termination — all data on that Breeze is permanently and irreversibly deleted. Kazepute is not responsible for any data loss resulting from Breeze destruction.
By Kazepute: We may suspend or restrict access to your Breeze or Account immediately and without prior notice if we reasonably believe that:
By You: You may cancel your Account and destroy your Breezes at any time through the Kazepute portal. Upon cancellation, your Breezes will be destroyed and all associated data permanently deleted.
Post-Termination: After account termination, we will retain your account information for up to 30 days to allow for potential reactivation. After this grace period, all personal data will be permanently deleted.
We strive to maintain high availability for all services. However, Kazepute does not guarantee any specific uptime percentage or service level. Scheduled maintenance will be communicated in advance through platform announcements when possible.
Kazepute shall not be liable for any downtime, service interruptions, or data loss caused by factors beyond our reasonable control, including but not limited to hardware failure, network outages, natural disasters, or acts of third parties.
The Kazepute platform, including its design, code, branding, logos, and documentation, is the property of Kazepute LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Kazepute platform without our prior written consent.
You retain all ownership rights to your Content. By using the Service, you grant Kazepute a limited, non-exclusive license to host, store, and transmit your Content solely for the purpose of providing the Service to you.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAZEPUTE'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO KAZEPUTE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL KAZEPUTE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, OR BUSINESS INTERRUPTION, REGARDLESS OF THE THEORY OF LIABILITY.
You agree to indemnify, defend, and hold harmless Kazepute LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States of America, without regard to its conflict of law provisions.
In the event of any dispute arising out of or relating to these Terms, the parties agree to first attempt to resolve the dispute through good-faith negotiation for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be settled by binding arbitration in Birmingham, Alabama, in accordance with the rules of the American Arbitration Association.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
Kazepute reserves the right to modify these Terms at any time. For material changes, we will provide at least thirty (30) days' notice via email to the address associated with your Account. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
Kazepute's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
